Terms of Service

Please read these Terms of Service carefully before using Litehost. By accessing or using our platform, you agree to be bound by these terms.

1. Overview

This Terms of Service Agreement (this "Agreement") is entered into by and between Litehost.io ("Litehost", "we", "us", or "our") and you ("User", "you", or "your"), and is effective as of the date you first use our website or services.

Litehost is a file hosting and sharing platform that allows users to upload files, create shareable links, manage projects, track analytics, and distribute content across the web. By creating an account or using any of our services, you confirm that you have read, understood, and agreed to be bound by this Agreement.

We may update this Agreement at any time. Changes take effect upon posting. Continued use of Litehost after any such change constitutes your acceptance of the revised terms. If you do not agree, you must stop using the platform.

2. Eligibility

You must be at least 18 years of age to use Litehost, or otherwise capable of forming a legally binding contract under applicable law. By using the platform, you represent and warrant that:

  • You meet the minimum age requirement.
  • You have full legal authority to enter into this Agreement on your own behalf, or on behalf of a corporate entity.
  • You are not subject to any legal prohibition on using online services of this nature under the laws of your jurisdiction.

If you register on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

3. Account Registration

To access most features, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information.
  • Keep your account credentials secure and confidential.
  • Notify us immediately at [email protected] of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account, whether authorized by you or not.

We reserve the right to suspend or terminate accounts that provide false or misleading information, or that have been inactive for an extended period.

4. The Services

Litehost provides a cloud-based file hosting and publishing platform. Our services include:

  • File Hosting & Sharing: Upload files and turn them into shareable public or private links, accessible from any device.
  • Project Management: Organize files into projects with configurable storage and file limits based on your plan.
  • Analytics: Track visitor activity including page views, visitor counts, geographic data, referral sources, and device types. Visitor recording is subject to plan limits.
  • QR Code Generation: Generate QR codes for any hosted project or file link.
  • Embed: Embed your hosted content directly into third-party websites and platforms.
  • Social Sharing: Share projects to social networks directly from the platform.
  • Smart Links: Create intelligent redirect links with routing logic (available on Pro plans and above).
  • Lead Capture: Display slide-in forms to capture visitor contact information (available on Pro plans and above).
  • Feedback Widget: Collect user feedback on hosted pages.
  • Visibility Controls: Password-protect projects and hide content from search engine indexing (available on Starter plans and above), and disable file downloads (available on Pro plans and above).
  • Email Access Control: Restrict access to pages by verified email address (available on Pro plans and above).
  • Custom Domains: Connect your own domain name to your hosted projects (available on Pro plans and above).
  • Analytics Export: Export your analytics data in CSV format.

Service features, limits, and availability vary by subscription plan.

5. Subscription Plans and Billing

Litehost offers a Free plan and paid subscription tiers: Starter, Pro, and Agency, each with defined limits and features. Accounts on a plan we no longer sell keep it, with its limits and features, while their subscription stays active.

  • Billing is handled through our third-party payment processor. By subscribing, you authorize recurring charges on your selected billing cycle (monthly or annual).
  • Plan Limits: Exceeding the storage or file limits of your plan may result in restricted functionality until you upgrade or reduce your usage.
  • Upgrades and Downgrades: You may change your plan at any time. Upgrades take effect immediately; downgrades take effect at the end of the current billing cycle.
  • Free Trial: New accounts may receive the Pro plan's features for a limited time (currently 7 days) at no charge and without a payment method. When the trial ends, the account moves to the Free plan unless you subscribe. Projects published during the trial stay online for 7 more days. After that, projects beyond your plan's project limit, and projects on a custom domain if your plan does not include custom domains, are paused: visitors see a notice instead of the content. Paused projects are not deleted; they come back when you upgrade, and archiving other projects lets you choose which ones stay online.
  • Founding Price: A limited number of subscribers may be offered a reduced Starter price (the "Founding Price"). The Founding Price applies for as long as that subscription stays active without interruption; it ends if the subscription is cancelled or changed to another plan.
  • Refunds: You may request a full refund within 14 days of your initial purchase or renewal. Refund requests submitted after 14 days will not be eligible, except where required by applicable law. To request a refund, contact us at [email protected] with your account email and order details.
  • Price Changes: We reserve the right to modify pricing at any time, with notice provided in advance of your next billing date.

6. Acceptable Use

You agree to use Litehost only for lawful purposes and in a manner consistent with this Agreement. You are solely responsible for all content you upload or publish through the platform.

You may not use Litehost to host, publish, or distribute content that:

  • Is illegal under any applicable local, national, or international law.
  • Contains or promotes child sexual abuse material (CSAM) or the exploitation of minors in any form.
  • Promotes or facilitates terrorism, violence, or incitement to hatred against any individual or group.
  • Infringes on any intellectual property rights, including copyrights, trademarks, or patents.
  • Violates the privacy or publicity rights of any individual.
  • Contains or distributes spam, unsolicited bulk messages, or deceptive communications.
  • Contains viruses, malware, ransomware, spyware, Trojan horses, or any other malicious code designed to disrupt, damage, or gain unauthorized access to systems.
  • Constitutes phishing, fraud, or deceptive practices intended to harm users.
  • Is pornographic, obscene, or otherwise harmful to minors.

Prohibited file types include, but are not limited to: .exe, .apk, .dmg, .cmd, .com, .bat, .msi, .app, .osx files, and any other executable or installer formats that may pose a security risk to users.

We monitor platform activity and reserve the right to remove content and suspend or terminate accounts that violate these guidelines, at our sole discretion, without prior notice.

7. User Content and Intellectual Property

Your Content. You retain all ownership and intellectual property rights in the files and content you upload to Litehost ("User Content"). By uploading content, you grant Litehost a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and distribute your User Content solely for the purpose of providing the services to you.

Content Marked Private or Password-Protected. We will not use User Content that you have designated as private or password-protected for any promotional or marketing purposes.

Litehost Content. All other content on the platform, including but not limited to the interface, design, software, trademarks, logos, and documentation, is the exclusive property of Litehost and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Litehost's proprietary content without express written consent.

User Submissions. Any feedback, suggestions, or ideas you submit to us (e.g., feature requests) are entirely voluntary. By submitting such information, you grant Litehost a perpetual, irrevocable, royalty-free license to use, implement, or otherwise act upon your suggestions without compensation or obligation to you.

8. Analytics and Visitor Data

By using Litehost's analytics features, you acknowledge that:

  • Analytics data is collected from visitors to your hosted pages and includes information such as IP addresses (anonymized), browser type, device type, referral source, geographic region, and page interaction data.
  • You are responsible for ensuring that your use of visitor analytics complies with all applicable privacy laws and regulations, including notifying your visitors and obtaining required consents in your jurisdiction.
  • Litehost provides analytics as a tool, and the accuracy or completeness of the data is not guaranteed.
  • Visitor recording limits are enforced per plan; once your monthly limit is reached, additional visitor data may not be recorded until the following billing period.

9. Custom Domains

Custom domains are available on Starter plans and above. When connecting a custom domain to your Litehost project, you represent that:

  • You are the legitimate owner or authorized user of the domain.
  • You will configure DNS records as required and are responsible for maintaining the domain registration.
  • You will not use custom domains to impersonate third parties, engage in phishing, or conduct activities that violate this Agreement.

Litehost is not responsible for domain registration, renewal, or DNS provider issues.

10. Data Backup and Storage

You are solely responsible for maintaining backups of your User Content. While we use commercially reasonable measures to preserve your data, Litehost does not guarantee that your content will not be lost, corrupted, or deleted. We strongly recommend that you maintain independent copies of all files you upload to the platform.

Storage limits are enforced according to your subscription plan. Uploads that would exceed your plan's storage quota may be rejected.

11. Service Availability

We strive to make Litehost available 24 hours a day, 7 days a week. However, availability may be interrupted due to:

  • Scheduled maintenance (we will attempt to provide advance notice).
  • Unplanned outages or infrastructure failures.
  • Events beyond our reasonable control, including but not limited to network failures, third-party service disruptions, or force majeure events.

Litehost makes no guarantee of uninterrupted or error-free service. We assume no liability for service interruptions.

Trial or Beta Features. From time to time, we may offer preview or beta features. These are provided "as-is" without warranty, and we may modify, discontinue, or limit access to such features at any time without notice.

12. Content Monitoring and Account Termination

Litehost does not routinely pre-screen User Content but reserves the right to:

  • Review and remove any content that violates this Agreement.
  • Suspend or permanently terminate any account for violations, at our sole discretion and without prior notice.
  • Cooperate with law enforcement investigations and comply with legal orders.
  • Remove and destroy data associated with terminated accounts.

Repeat violations will result in permanent account termination.

13. Reserved Rights

Litehost expressly reserves the right to deny, cancel, suspend, or modify access to any account or service at any time, including to:

  • Correct errors in service delivery.
  • Prevent fraud or abuse.
  • Comply with applicable laws, regulations, or court orders.
  • Respond to law enforcement requests.
  • Protect Litehost from legal liability.

14. Third-Party Services

Litehost integrates with and relies on various third-party services (including authentication, payment processing, infrastructure, and analytics providers). We are not responsible for the conduct, availability, or content of any third-party service. Your use of third-party services integrated with Litehost may be subject to those services' own terms and privacy policies.

Links or integrations with third-party platforms do not constitute an endorsement by Litehost.

15. International Data Transfers

Litehost may transfer your data to and process it in countries other than your country of residence, including countries that may have different data protection laws. By using the platform, you consent to such international transfers.

16. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS-IS", "AS AVAILABLE", AND "WITH ALL FAULTS". TO THE FULLEST EXTENT PERMITTED BY LAW, LITEHOST EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LITEHOST DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM LITEHOST SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LITEHOST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND THIRD-PARTY PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • YOUR USE OF OR INABILITY TO USE THE SERVICES.
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
  • LOSS OF DATA OR CONTENT.
  • ANY INTERRUPTION OR CESSATION OF THE SERVICES.
  • THIRD-PARTY CONDUCT ON OR THROUGH THE PLATFORM.

IN NO EVENT SHALL LITEHOST'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO LITEHOST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES.

18. Indemnification

You agree to defend, indemnify, and hold harmless Litehost and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the services.
  • Your violation of this Agreement.
  • Your User Content.
  • Your violation of any third-party rights, including intellectual property or privacy rights.

19. Discontinued Services

Litehost reserves the right to discontinue any service or feature at any time. Where feasible, we will provide at least 30 days' advance notice before discontinuing a service you rely on. Litehost is not liable for any loss or damage resulting from service discontinuation.

20. Governing Law

This Agreement is governed by and construed in accordance with the laws of the applicable jurisdiction where Litehost operates, without regard to conflict of law principles. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.

21. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

22. Entire Agreement

This Agreement, together with our Privacy Policy and any other policies referenced herein, constitutes the entire agreement between you and Litehost with respect to the use of the services and supersedes all prior agreements.
